These terms explain how Plan Heavy works and what we each agree to when you use it. Please read them. If you do not agree, please do not use Plan Heavy.
1. Who we are
Plan Heavy is a going-out directory and planning service for the UK, available at planheavy.co.uk and in the Plan Heavy app. It is run by [LEGAL NAME] ("Plan Heavy", "we", "us"), of [POSTAL ADDRESS].
You can contact us at help@planheavy.co.uk.
2. Accepting these terms
By creating an account, you confirm that you have read and accept these terms and our Privacy policy. You cannot create an account without accepting them.
If you use Plan Heavy without an account, these terms still apply to that use.
When we make an important change to these terms, we will ask you to accept the new version the next time you sign in. If you do not accept it, you can delete your account at any time (see section 12).
3. How we use data to run Plan Heavy
Plan Heavy only works because we can see how it is used. So, as a condition of using Plan Heavy, you agree that we record how you use the website and the app, for example what you search for, which places and pages you open, which videos you watch and for how long, what you save, and which buttons you press.
We use this to run the service, keep it safe, fix problems, decide what to build, and improve it for you, for the venues listed and for our partners. We show venues and curators totals and trends only, never information that identifies you. Our Privacy policy explains exactly what we record, why, how long we keep it, and your rights.
Some things are your choice and are off unless you turn them on or can be turned off:
- tracking by other companies (such as Meta, TikTok or Google advertising tools)
- recommendations tailored to you
- marketing emails
4. Who can use Plan Heavy
You must be at least 13 to create an account. We ask for your date of birth when you sign up, and it must be true.
If you are under 18, you need a parent or guardian's permission to buy anything on Plan Heavy. We never send marketing about alcohol to anyone under 18, and recommendations are not tailored to under 18s.
Plan Heavy is for personal use. You may not use it on behalf of a business unless you hold a business or curator account for that purpose.
5. Your account
- Keep your sign-in details private. You are responsible for what happens on your account.
- Give us accurate details and keep them up to date.
- One person, one account. Do not create accounts to get around limits.
- Tell us straight away at help@planheavy.co.uk if you think someone else has used your account.
6. What Plan Heavy is, and what it is not
Plan Heavy helps you find places to eat, drink and go, and plan your time out. We curate the places we list, and we work hard to keep details right. But venues change prices, menus, opening hours and policies without telling us.
So:
- Always check important details with the venue before you go, especially opening times, prices and booking.
- Dietary and allergy information. Where we show a dish as vegan, halal, gluten free or similar, it means the venue's own menu says so, or we have checked it. It is not a guarantee. If you have an allergy or a strict dietary need, always confirm with the venue before you order. Plan Heavy is not responsible for what a venue serves.
- Accessibility information comes from venues and our own visits. Please check with the venue if you rely on it.
- Prices are a guide. We hide menu prices we have not been able to check recently.
- Walks and outdoor routes are suggestions. Check conditions, weather and your own fitness before you set off. You are responsible for your own safety.
7. Heavy One
Heavy One is our AI planning assistant. It answers questions about places on Plan Heavy and builds plans for you.
- Heavy One works from the information stored on Plan Heavy. It can still make mistakes. Check anything important with the venue.
- Do not put sensitive personal information into Heavy One (for example health details or bank details). It does not need them.
- Heavy One has allowances. Visitors without an account, free accounts and Members each get different allowances. The current allowances are always shown in the app and on the website. We may change them, including during busy periods, to keep the service running fairly for everyone.
Plan credits on a free account:
- A free account gets one plan credit each month. One credit pays for one saved Heavy One plan.
- Each credit allows up to three attempts. An attempt starts when you add your first stop to a Heavy One plan.
- If you leave without saving and come back to plan again, that is your next attempt.
- Your third attempt is kept on your account and cannot be deleted or replaced. You can save it, which uses the credit, or leave it until your credit renews.
- Saving a plan uses the credit. Credits are not refunded once a plan has been saved or the third attempt has started.
- Credits do not carry over to the next month and have no cash value.
- Swapping a stop for one of the alternatives shown, changing times, and building a plan yourself in the Plan Builder do not use credits. We may set fair-use limits on these to stop the service being misused.
8. Membership
Plan Heavy Membership gives you more from Plan Heavy, including fuller use of Heavy One, within fair use.
- Price and billing. The price is shown before you pay. Membership renews automatically each [month / year] until you cancel.
- Offers. We sometimes run introductory offers (for example a reduced first month). The offer price applies only for the period stated, then the normal price applies unless you cancel.
- Cancelling. You can cancel at any time in your account settings. Your Membership stays active until the end of the period you have paid for, then stops. We do not refund part periods, except where the law requires it.
- Your right to cancel. If you live in the UK, you have 14 days from buying to cancel and get a refund. Because Membership starts straight away, if you use it during those 14 days we may take off an amount for the part you have used. [SOLICITOR TO CONFIRM WORDING]
- Buying in the app. If you buy Membership through the Apple App Store or Google Play, that store takes the payment and its own terms apply. You must cancel and request refunds through the store.
- Fair use. "Unlimited" means unlimited within normal personal use. We may limit use that looks automated, shared or abusive.
9. Bookings, offers and other companies
- Some booking buttons take you to other companies, such as DesignMyNight or OpenTable, or to the venue's own website. Your booking is with them and the venue, under their terms. We are not part of that contract.
- Offers and coupons shown on Plan Heavy are set by the venue. The venue decides whether to honour them. Offers have their own conditions and end dates.
- Videos on Plan Heavy are made by their creators and credited to them. Some play from other platforms such as TikTok or YouTube, whose own terms apply.
- Maps are provided by other companies (such as Google, Mapbox and OpenStreetMap).
10. What you post
You may post reviews, star ratings, photos, tips, plans and other content ("your content").
- You keep ownership of your content. You give Plan Heavy a free, worldwide, non-exclusive licence to show, store, copy, resize and share your content on Plan Heavy, in the app and in our own promotion of Plan Heavy, for as long as it is on Plan Heavy, and to let other users view it.
- Reviews must be honest and your own. Only review places you have visited. Do not post reviews in return for payment, freebies or other rewards unless you say so clearly in the review. Do not review a business you own, work for or compete with. Fake reviews are against UK law.
- Do not post anything unlawful, hateful, threatening, sexual, misleading, or that shares someone else's private information.
- Only upload photos you took or have the right to share. Do not upload photos of other people where they can be identified without their permission.
- Photos are checked by our team before they appear. We may refuse or remove any content that breaks these terms.
- Plan Heavy shows reviews from our own users and reviews from Google, together in one list. Reviews from Google are shown with their author's name and a source mark.
11. Things you must not do
You must not:
- copy, scrape, crawl or download content or data from Plan Heavy by automated means, or use it to train or feed any AI system, without our written permission
- try to get around allowances, limits or sign-up requirements (for example by using several accounts or hiding who you are)
- interfere with or try to break the security of Plan Heavy
- use Plan Heavy to send spam or advertise without our permission
- pretend to be someone else, or to represent a venue or creator you do not represent
- use Plan Heavy in a way that breaks the law
12. Ending your account
You can delete your account at any time in your account settings.
- Your account is closed straight away, and permanently deleted after 30 days. If you sign in within those 30 days, it is restored.
- When you delete your account, your public plans and reviews are deleted too, unless you choose to leave them up without your name. They then show as written by "A Plan Heavy member".
- Deleting your account cancels a Membership bought on our website. If you bought it through the App Store or Google Play, cancel it there too.
- Our Privacy policy explains what we keep after deletion and why (for example payment records we must keep by law).
We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or to protect other users or venues. Where it is reasonable, we will tell you why and give you a chance to respond.
13. Our responsibility to you
- We provide Plan Heavy with reasonable care and skill. Nothing in these terms takes away your legal rights as a consumer.
- We are not responsible for what venues, booking companies or other third parties do, including the food, drink, service or experience a venue provides.
- We are not responsible for losses we could not reasonably have foreseen, or losses caused by you not following these terms or not checking details with a venue.
- We do not exclude liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, or for fraud.
- Plan Heavy may sometimes be unavailable while we fix or improve it. We will try to keep this short.
14. Business owners and curators
Venue owners who claim a listing, and curators who join our curator programme, also agree to extra terms that apply to those accounts: [link to Business terms] and [link to Curator terms]. If those terms conflict with these, the extra terms apply for that part of the service.
15. Changes to Plan Heavy and to these terms
We are always improving Plan Heavy and may change or remove features. We may update these terms. If a change is important, we will tell you before it takes effect and ask you to accept the new version when you next sign in.
16. The law that applies
These terms are governed by the law of England and Wales. If you live elsewhere in the UK, you can also bring a claim in the courts where you live.
If you have a problem, please contact us first at help@planheavy.co.uk. We will do our best to put it right.
